ok my moms bf got into the drive way tonite and the cops got him as soon as he parked the care in the drive way and they gave him a servriety test and we caught it on video that he ovbiously passed but they said they said he failed. can we fite this? plz helpSome one plz help. 10 easy points for best advice?
Call your lawyer, they can arrest him even if he has only had one drink. the city and state make so much money on the these arrests that they don't care whether he is at a legal limit or not they say let the judge decide ! In the meantime it will cost you thousands of dollars in court costs and lawyers fees. Yes, you can definitely try fighting it, and if you have proof, then there should be no problem, but that does not mean that you will win. Unfortunately the cops are going to stick by their story. Try fighting it, you don't have anything to loose. Good luck and I hope that things go well for you and your mom's boyfriend.

If the tape you recorded clearly shows that he passed it then Yes I would say you can fight it. Hire a GOOD lawyer and there you go!
You mean a ';sobriety'; test? If there's any question about whether or not he was intoxicated, a blood test should do the trick. Have him ask for one.
Was he actually sober. They will do a bloood test as well if you fight ont this one so I may just let it go sinced he passes their dumbass tset.
